Five steps toward a successful settlement of a personal injury case:
1. Choose the right doctor. A doctor who has a good reputation with courts and insurance companies lends credibility to your claim. Unless your physician has experience with accident cases, he or she may inadvertently harm your case. Effective personal injury lawyers know which doctors to use.
2. Tell your doctor about everything that hurts. It is critical to the success of your case to show and tell the jury how you feel and how your injuries affect your daily life. Your doctor will keep detailed records of your medical history and care. These records include your description of your injuries, your physical complaints, the physical examination and the treatment you received. The insurance company will base its offer on this information. If you don’t tell the doctor everything that hurts, you won’t receive complete treatment, and no one will know the extent of your injuries.
3. Follow your doctor’s orders. If your doctor prescribes therapy three days a week but you go only once per week, you will damage your claim. The insurance company will argue that if you were truly injured, you would have followed your doctor’s orders. The insurance company then might reduce its settlement offer based on your failure to follow your doctor’s orders.
4. Keep a diary documenting your injuries. Few people think of documenting their injuries. However, a diary will help you remember how you felt on a day-to-day basis and the way your injuries affected your life. Your diary will help you show the adjuster or the jury the full extent of your injuries and can mean a more complete understanding of your claim.
5. Think before you speak to the insurance company. The insurance company will use everything you tell it to diminish your claim. And, under no circumstances should you exaggerate or lie. If you tell the truth, you will never have to worry about what you said.
